PREAMBLE  

These General Terms and Conditions constitute the rules applicable within the scope of the sale of AIRLINES ORIGINALS products,  

Between: KM DIFFUSION, a company with registered offices located at ZA de Pédebert 40150 Soorts-Hossegor France, listed on the Trade and Companies Register of Dax under registration n° 508 369 816 (hereinafter referred to as "AIRLINES ORIGINALS").

And any legal person of legal age not engaged in business (hereinafter referred to as "the Customer") exclusively domiciled in Metropolitan France and in the following countries of the EEC: Germany, Belgium, The Netherlands, Luxembourg, Spain, Great Britain, Italy, Austria, Denmark, Ireland, Portugal, Norway, Sweden, Switzerland, Greece, Hungary, Iceland, Poland, Czech Republic, Slovakia, Slovenia, making a purchase on the www.airlinesoriginals.com website (hereinafter referred to as “the Site”).  

The site is hosted by ALYS, a company with registered offices located at 38 rue Théodore de Cuyper, 1200 Brussels, Belgium.  

Clause 1 - Purpose  

The purpose of these General Terms and Conditions, drafted in English (originally in French), is to specify the conditions on which the products stamped AIRLINES ORIGINALS are marketed to the customer on the site. They thus settle all the necessary steps, from the placement of an order by the Customer to the delivery of the Products to the same.  

Clause 2 – Products  

The products offered for sale by AIRLINES ORIGINALS are those featured on the site on the day it is viewed by the Customer. KM DIFFUSION undertakes to deliver products meeting current regulations relative to health and safety in accordance with European provisions and, in particular, legislation on controlled chemical substances.  

Clause 3 – Prices  

Product prices are shown in Euros inclusive of all taxes, applicable on the day on which the order is placed, and do not include shipping costs.  

Clause 4 – Orders  

4.1 – Placing an order  

The Customer will select the chosen products by adding them to his or her shopping basket. In order to allow the Customer to return to his or her order and correct any errors, confirmation and acceptance screens are provided. The order will only be definitively placed when final confirmation is given, when bank/payment details have been entered. As of the final click to accept, the order is considered definitive, subject to the stipulations under Clauses 5 and 6 below. Any order placed by the Customer, realized by entering bank/payment details, implies the full and whole acceptance of these General Terms and Conditions of Sale, to the exclusion of any and all other Conditions of Sale applicable elsewhere by KM DIFFUSION.  

4.2 – Order confirmation  

KM DIFFUSION will immediately confirm the acceptance of the order by sending a confirmation message to the email address that the Customer will have provided when entering his or her full details when placing his or her order.  

4.3 – Archiving the order  

Any order placed on the site will be archived for 10 years and accessible by the Customer on request via the contact form.  

Clause 5 - Conditions of payment  

Payment is made online by bank card when the order is placed by the Customer. Cards accepted are Cartes Bleues debit cards, Visa and MasterCard. The Customer’s bank account corresponding to the card used will be debited 3 (three) clear days as of the placement of the order. In the event of a payment failure, incorrect address or any other problem with the Customer’s account, KM DIFFUSION reserves the right to block the Customer’s order until the problem is resolved.  

Clause 6 – Payment security  

Protection against any fraudulent use of payment methods used for the transaction, particularly further to hacking/piracy or against any challenge or dispute relating to the price of an order, is provided by OGONE. The Customer’s order will only be deemed effective when the secure payment centre and OGONE have both approved the transaction and, if necessary, further to acceptance on the part of OGONE’s insurer to underwrite the risk. In the event of a refusal on the part of the secure payment centre or OGONE, the order will be automatically cancelled and the Customer informed of the same immediately by email. The discovery of an outstanding amount owing to the fraudulent use of a bank card will lead to the registration of the details relating to the order associated with said outstanding amount in a payment incident file set up by OGONE. An irregular declaration or anomaly will also be subject to a specific handling process.  

Clause 7 – Delivery  

7.1 – Delivery location  

KM DIFFUSION will only deliver orders to the following countries within the European Union: Germany, Belgium, The Netherlands, Luxembourg, Spain, Great Britain, Italy, Austria, Denmark, Ireland, Portugal, Finland, Norway, Sweden, Switzerland, Greece, Hungary, Iceland, Czech Republic, Slovakia and Slovenia. The order is delivered to the Customer’s address or to any other address that the Customer provides when placing his or her order.  

7.2 – Delivery times   Subject to payment being made for the order, delivery will be made to the Customer within 2 to 8 working days depending his or her location, by the transporter chosen by KM DIFFUSION (COLISPOSTE, parcel to be signed for). Delivery times stated here are by way of illustration.  

7.3 – Shipping/delivery costs  

The costs of shipping and delivering Products to the Customer are not included in the sale price.

Clause 8 – Right of withdrawal  

In accordance with Section L121.20 of the Code de la Consommation (French Consumer Code) the Customer has a period of 7 (seven) clear days from receiving the Products to exercise his or her right of withdrawal, without any justification or penalty, except for transportation costs for which the Customer remains liable.  

Clause 9 - Complaints – Returns   For any complaint or return, the Customer will be able to contact KM DIFFUSION via the contact form in order to obtain a return number. As of the date of receipt of his or her order and aside from the withdrawal time, the Customer has a period of 7 (seven) clear days in which to communicate his or her intention to return the Products. Once this period has expired, the product(s) delivered will be deemed suitable and accepted by the Customer. The Customer undertakes to return any and all unwanted Products within a period of 7 (seven) clear days as of the communication of the return number by KM DIFFUSION. Once this period has expired, the product(s) delivered will be deemed suitable and accepted by the Customer. The total sum of any Product returned within the periods stipulated above will be re-credited to the card used in the transaction within a period of 30 (thirty) days as of the receipt of the returned Product(s). A Product may only be returned to KM DIFFUSION if it has not been worn or used, is in perfect condition and in its original packaging. The Customer will return the Product(s) by post to the following address: KM DIFFUSION AIRLINES ORIGINALS ZA de Pedebert 455 av. de Pascouaou 40150 Soorts-Hossegor FRANCE  

Clause 10 – Data protection  

10.1 – Personal information being necessary for the handling and delivery of orders and generating invoices, the collection of such information within the scope of remote sales is required. This information is strictly confidential and solely intended for KM DIFFUSION and/or its suppliers, strictly within the scope of managing the Customer’s order. In accordance with Law n°78-17 of 6 January 1978 as amended by the Law of 6 August 2004, the Customer has the right to access, amend, rectify and delete his or her personal data. In order to exercise that right, the Customer must make his or her request via the contact form.  

10.2 – Information relating to the payment method for each order are subject to automatic processing for which OGONE is responsible. The outcome of this automated data processing is to establish a level of analysis of a transaction and to fight against card fraud in particular. The non-transmission of data relating to the payment method for the order prevents the completion and analysis of the transaction. The www.airlinesoriginals.com website is the subject of a declaration to the CNIL (French National Commission for Information Technology and Civil Liberties) under number 140 18 70.  

Clause 11 - Force Majeure  

KM DIFFUSION shall not be liable for the non-performance, in whole or in part, of its obligations regarding the order placed by the Customer, where said non-performance is caused by an event constituting a case of force majeure as defined under substantive law. In such a hypothetical scenario, KM DIFFUSION shall inform the Customer of the emergence of such an event within a period of 3 (three) clear days following its emergence, via email. Once a period of 1 (one) month has expired, should the hypothetical scenario or event constituting a case of force majeure persist, the order shall be cancelled and will be the subject, where necessary, of reimbursement within 30 (thirty) days by KM DIFFUSION to the card used when placing the order.  

Clause 12 – Intellectual property  

All elements on the website are protected either by copyright or by trademark law. They are the exclusive property of KM DIFFUSION.  

Clause 13 - Limitation of liability   The placing of an order on the Site involves the knowledge and acceptance of current procedures on the Internet, particularly as regards technical performances, response and connection times, enquiries or information transfers, the risks of contamination by viruses circulating on the Internet network and, generally, all risks linked to Internet use. KM DIFFUSION may not, under any circumstances, be held liable for any direct or indirect damage resulting from incorrect use or an incident related to the use of a computer, Internet access, the maintenance or malfunction of servers, telephone lines or any other technical connection, the Customer’s connection to the website being entirely at his or her own risk.  

Clause 14 – Law applicable  

These General Terms and Conditions of Sale are subject to French law. Please write to us if you do not find the answer to your question in these sections.
